SeekInvest Inc. (“SeekInvest” or “We”) are committed to safeguarding the privacy of the users of our website and services.

This policy describes the types of information we may collect from you or that you may provide when you visit or use the SeekInvest site located at the URL https://www.seekinvest.com/ or successor URLs (the “Site”) and our practices for collecting, using, maintaining, protecting, and disclosing that information.

  • In email, text, and other electronic messages between you and this Site.
  • When you interact with our advertising and applications on third-party Sites and services, if those applications or advertising include links to this Privacy Policy.

  • Us offline or through any other means, including on any other websites operated by any third party; or
  • Information that customers using the SeekInvest services provide or upload (or direct others to provide or upload) and store in the Service. In those circumstances:
    • SeekInvest is a processor and is acting on behalf of a customer in relation to any such data and that customer is responsible for the collection and use of your data; and
    • The SeekInvest customer’s privacy notice will apply to the collection and customer’s use of such data.
    • In such circumstances you should refer to their privacy notice and direct any queries to the relevant SeekInvest customer. The provisions of the customer’s agreement with SeekInvest govern our use of and processing of data our customers provide us in course of providing Service (“Customer Data”) on Customer’s behalf in those circumstances. 
  • Any third party (including our affiliates and subsidiaries), including through any application, content or advertising that links to or is accessible from or on the Site;

Please read this policy carefully to understand our policies and practices pertaining to your information. If you do not agree with our policies and practices, you may choose not to use our Site. By accessing or using this Site, you agree to this Privacy Policy.

Information We Collect and How We Collect It

We collect several types of information from and about users of our Site, including information:

  • By which you may be personally identified, such as name, postal address, e-mail address, telephone number or other personal information collected (“Personal Information”);

  • From your clients (“Customer Client”) if you direct them to provide such information to us in which case your agreement with us will govern such collection rather than this Privacy Notice
  • From third parties, for example, our business partners.
Information You Provide to Us

The information we collect on or through our Site may include:

  • Information you provide by filling in forms on our Site. This includes information provided at the time of registering to use our Site, subscribing to our service, posting material, or requesting further information or services. We may also ask you for information when you enter a contest or promotion sponsored by us, and when you report a problem with our Site.
  • Information may also be entered by users of our Service, on their own behalf, or for benefit of a Customer Client.  Such information will be governed by your agreement with us. 
  • Records and copies of your correspondence, including email addresses, if you contact us.
  • Your responses to surveys we might ask you to complete for research purposes.
  • Your search queries on the Site.

You also may provide information to be published or displayed (hereinafter, “posted”) on public areas of the Site or transmitted to other users of the Site or third parties (collectively, “User Contributions”). Your User Contributions are posted on and transmitted to others at your own risk. Although we limit access to certain pages, please be aware no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Site with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee your User Contributions will not be viewed by unauthorized persons.

Information We Collect Through Automatic Data Collection Technologies

It helps us to improve our Site and to deliver a better and more personalized service, including by enabling us to: estimate our audience size and usage patterns; store information about your preferences, allowing us to customize our Site according to your individual interests; speed up searches; recognize you when you return to our Site.

We use information that we collect about you or that you provide to us, including any personal information:

  • To present our Site and its contents to you.
  • SeekInvest may also use Personal Information to send you information regarding the Site, products, services, your account status, this Privacy Policy, or any other information relevant to your use of the Site, products and/or services. We will engage in this activity to manage our contractual relationship with you and/or to comply with a legal obligation.  We may also use Personal Information about you for other business purposes, such as administering and facilitating Site access, providing customer support, completing business transactions, product development, receipt of services from you or your employer, administering individual accounts, and improving the functionality, content and layout of the Site including through analysis of user behavior.
  • We may use Personal Information as necessary to comply with applicable legal and regulatory requirements, to comply with a civil, criminal, or regulatory inquiry, investigation, subpoena, or summons by federal, state, or local authorities.
  • If you are a client of our Customer, and you have not otherwise interacted directly with us, we will only use your information in providing Services to the Customer who directed you to the Site.
  • SeekInvest may aggregate Personal Information in a manner such that the resultant data does not personally identify you or any other person or Site user. Such aggregate information may be used for any purpose.

We may also use your information to contact you about our own and third-parties’ goods and services that may be of interest to you. If you do not want us to use your information in this way, please contact us by sending an email to: [email protected].  

We may use the information we have collected from you to enable us to display advertisements to our advertisers’ target audiences. Even though we do not disclose your personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.

Disclosure of Your Information

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.  We do not sell personal information about current or former users or their clients to third parties.  We may disclose personal information that we collect or you provide as described in this privacy policy:

  • To our subsidiaries and affiliates.

  • To a buyer or other successor of SeekInvest in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of SeekInvest assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by SeekInvest about our Site users is among the assets transferred.
  • To third parties to market their products or services to you if you have consented to/ not opted out of these disclosures. We contractually require these third parties to keep personal information confidential and use it only for the purposes for which we disclose it to them. 
  • To fulfill the purpose for which you provide it; or for any other purpose disclosed by us when you provide the information.
  • With your consent.

We may also disclose your personal information:

  • To enforce or apply our terms of use and other agreements, including for billing and collection purposes.

  Links The Site may contain links to other Internet web sites, including social media sites and third-party hosted collaboration tools. SeekInvest does not endorse or control, and is not responsible for, the privacy practices or the content of any linked sites. If you provide any Personal Informationthrough any third-party web site, or choose to communicate with us using third-party collaboration tools or other social media platforms, your transaction will occur on that third party’s web site and not on this Site and the Personal Information you exchange will be collected and controlled by the privacy policy of the third party. PLEASE NOTE THIS PRIVACY POLICY IS ONLY PERTINENT TO SEEKINVEST AND DOES NOT ADDRESS THE PRIVACY PRACTICES OF ANY THIRD PARTY.   Sensitive Personal Information Restriction Unless we specifically request for information to comply with applicable laws, we ask that you not send us, and you not disclose, any sensitive Personal Information such as: social security numbers, passport numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, criminal background or trade union membership on or through this Site or otherwise to us.   Legal Basis For Processing Personal Information (applies to EEA, Switzerland visitors): If you are a visitor to this Site based in the European Economic Area (“EEA“), SeekInvest is the data controller of your personal information.   Our legal basis for collecting and using the personal information described above will depend on the personal information concerned and the specific context in which we collect it. However, SeekInvest will normally collect personal information only where we have your consent to do so, where SeekInvest needs the personal information in order to perform a contract with you, or where the processing is in SeekInvest legitimate interests and not overridden by your data protection interests or fundamental rights and freedoms provided under law. In some cases, SeekInvest may have a legal obligation to collect personal information from you.    If we ask you to provide personal information to comply with a legal requirement or to perform a contract with you, we will make this clear at the relevant time and advise you whether the provision of your personal information is mandatory or not.      Children Under the Age of 13 Our Site is not intended for children under 13 years of age and no one under age 13 may provide any personal information to the Site. If you are under 13, please do not use or provide any information on this Site, register on the Site, use any of the interactive or public comment features of this Site, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If you are a User of our Service, or directly interacted with us through the Site, and are not a Customer Client, You may send us an email at [email protected] in order to request access to, correct or delete any Personal Information you have provided to us. You may also review and change your personal information by logging into the Site and visiting your account profile page.  We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.  If you provided information to a SeekInvest Customer, or to us at the direction of a SeekInvest customer, please work directly with that customer on accessing and correcting such information.

  Data Security

SeekInvest maintains measures to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure.  However the safety and security of your information also depends on you.  You are responsible for keeping your Site passwords confidential and thus we ask you not to share your password with anyone. Please note that the information you share in public areas may be viewed by any user of the Site.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Site. Any transmission of personal information is at your own risk.

Data Transfers

Your personal information may be transferred to, and processed in, countries other than the country in which you are resident. These countries may have data protection laws that are different to the laws of your country, and in some cases, may not be as protective.

Specifically, our Site servers are located in the U.S., and our affiliates/partners and third-party service providers operate in the U.S.

  EEA and Switzerland Users: Your Privacy Rights In Respect Of Certain Data If personal information pertaining to you as an individual has been submitted to the Service by or on behalf of a SeekInvest customer and you wish to exercise any data protection rights you may have in respect of that data under applicable law, including the right to access, correct, amend, or delete such data, please inquire with the customer directly.  SeekInvest has a limited ability and rights to access data we process on behalf of our customers.  However, if you wish to make your request directly to us, please provide the name of the customer who submitted your data to our Service.  We will refer your request to that customer and will support them as needed in responding to your request within a reasonable timeframe.   Retention Period We will retain Personal Information about you for as long as needed or permitted in light of the purpose(s) for which it was obtained and consistent with applicable law. The criteria used to determine our retention periods include: (i) the length of time we have an ongoing relationship with you; (ii) whether there is a legal obligation to which we are subject; and (iii) whether retention is advisable given our role and the applicable statutes of limitations, and pendency of any litigation or regulatory investigations.   Changes to Our Privacy Policy

It is our policy to post any changes we make to our privacy policy on this page. If we make material changes to how we treat our users’ personal information, we will notify you through a notice on the Site home page.
